KPMG's Private Client Update, July 2010: Residence for UK tax purposes
Currently there is no single statutory test for residence in the UK. An individual who is in the UK for 183 days or more in a tax year will be UK resident. Someone who spends no time in the UK in a tax year is unlikely to be resident. In other cases HMRC and, if necessary, the Courts determine a person’s residence status from case law principles. Recent cases, such as that of Mr Gaines-Cooper, have attracted substantial media interest. This update is intended to provide a high-level summary of UK residence; it is not a substitute for professional tax advice.

Non-Doms, the payment of fees and the Services Exemption
Non-Doms need to take great care when fees are paid for services provided in the UK. Unintended tax charges can arise on a Non-Dom beneficiary or shareholder as a result of offshore trustees or directors paying fees to a UK advisor in respect of advice provided in the UK. The 'Services Exemption' may prevent a tax charge arising, but this only applies in certain limited circumstances.

It is possible that Non-Doms may have realised capital losses during the 2008/09 tax year. Since April 2008 where these losses arise on assets situated outside the UK, tax relief may be available. Such relief is only available if the necessary election is made.

The nascent carbon markets have grown rapidly since their inception in the mid-2000s, and in particular have seen an explosion in volumes on the spot market this year. The spot market has been hit by rumours of VAT carousel fraud in a number of Member States originating in France. This has prompted a range of responses from Member States, from exemption in France to the restriction of VAT recovery by those who knew or should reasonably have known of the fraud in the UK.

The influence of EU law on tax systems across Europe is growing. Individuals and corporates are increasingly making use of EU law in order to challenge the legality of member state tax rules. Changes to member states tax rules are being driven by the influence of EU law. This document considers the implications of some recent developments in EU law and recent EU tax cases for any entity involved in stock lending arrangements.

A Code of Conduct for the Tax Arena
This paper, written by Robyn Pellew at KPMG's Tax Business School, highlights the potential advantages of a non legislative solution to some of the current frustrations with the UK tax system.
